Medical records

Under Section 7 of the Data Protection Act 1998, subject to certain conditions, all living individuals have a legal right of access to the personal information held about them.

Access to the record of a deceased person is governed by the Access to Health Records Act 1990. Under this legislation, the personal representative, executor or administrator, or anyone having a claim resulting from the death can apply for access to the deceased's health records.
